Welcome to ShiftLink. This website, mobile application, workforce allocation software, and related services are owned and operated by SHIFTLINK WORKFORCE SOLUTIONS LLP (hereinafter referred to as "ShiftLink", "we", "us", or "our").

By accessing our website, registering an account, posting shifts, or deploying shift talent, you agree to be legally bound by these Terms and Conditions. Please review them carefully before using our platform.

1. Platform Role & Nature of Services

ShiftLink provides a digital marketplace and technological workflow bridge connecting businesses requiring temporary and flexible personnel ("Clients / Businesses") with independent short-term workers and service providers ("Shift Talent / Workers").

2. User Accounts & Platform Eligibility

• Age & Authority: You must be at least 18 years of age and legally competent to enter into enforceable agreements under the Indian Contract Act, 1872. Authorized representatives executing accounts on behalf of businesses confirm they possess legal authority to bind that entity.
• Verification & KYC: All businesses and workers must provide accurate, updated credentials. We reserve the unilateral right to suspend or terminate accounts that fail our identity, licensing, or background verification checks.
• Account Integrity: You are responsible for safeguarding your login credentials and for all shift bookings initiated from your account.

3. Shift Postings, Billing & Payment Processing

• Rates & Invoicing: Shift charges, commission fees, and platform service subscriptions are clearly specified on the booking interface prior to confirmation.
• Payment Aggregator: All electronic transactions, UPI payments, debit/credit card settlements, and digital invoicing are processed through RBI-authorized payment aggregators, specifically Razorpay. By initiating a transaction, you agree to comply with Razorpay’s customer terms and security requirements.
• Taxes: All billable rates are subject to applicable statutory taxes, including Goods and Services Tax (GST) in accordance with prevailing Indian laws.

4. Cancellations & Shift Alterations

Shift bookings and workforce reservation fees are governed strictly by our published Refund & Cancellation Policy. Cancellations executed after worker confirmation or within minimum cut-off hours are subject to standard operational charges.

5. On-Site Conduct & Safety Compliance

Businesses utilizing ShiftLink talent agree to maintain safe, hygienic, and lawful workplaces that comply with Indian industrial and labour safety guidelines. Businesses must not deploy platform workers to perform tasks outside the agreed shift scope or subject them to hazardous environments without explicit safety protections.

6. Limitation of Liability

To the maximum extent permissible by law, SHIFTLINK WORKFORCE SOLUTIONS LLP, its partners, and employees shall not be liable for indirect, incidental, punitive, or consequential damages resulting from shift non-fulfillment, on-site conduct of third-party personnel, or scheduled server maintenance.

7. Governing Law & Jurisdiction

These Terms shall be interpreted and governed in accordance with the laws of India. Any legal dispute, arbitration, or action arising out of these Terms shall fall under the exclusive jurisdiction of the competent courts in Vasco Da Gama / South Goa, India.
